Employment Litigation & Alternative Dispute Resolution

Our attorneys have the knowledge and experience necessary to handle all aspects of employment litigation from the first notice of a complaint through trial and appeals. Battles in employment disputes often rise and fall with determinations made at the administrative agency level, including the Equal Employment Opportunity Commission (EEOC), Arizona Civil Rights Division (ACRD), Department of Economic Security (DES), Occupational Health and Safety Administration (OSHA), National Labor Relations Board (NLRB) and Department of Labor (DOL). Our experience and relationships with these agencies has resulted in the successful resolution of hundreds of employment disputes at the administrative stage.

Internal Investigations

RH employment attorneys are well equipped to conduct independent investigations for their clients upon the first notice of inappropriate conduct in the workplace, including allegations involving discrimination, harassment and improper business practices. Upon the conclusion of our investigation, we work with our clients to craft an appropriate response and action plan to restore harmony to the workplace and limit legal exposure.

Wage and Hour Compliance Under The Fair Labor Standards Act (FLSA)

We partner with employers to design and implement practical policies and procedures that ensure compliance with the many complex laws governing working hours and the payment of wages, including those concerning: the classification of exempt, non-exempt and independent contractor workers; calculation of overtime, commission, bonuses and other premium pay issues; recordkeeping obligations; and, vacation, personal and sick time compensation policies.

Immigration Reform and Control Act (IRCA) / Form I-9 & E-Verify Compliance

We advise employers on best practices for ensuring compliance with their obligations under the IRCA, including verifying the identity and employment eligibility of employees through the completion of Form I-9 and E-Verify process. Our employment attorneys also have the experience necessary to represent employers in Department of Homeland Security investigations, provide guidance on Social Security no-match issues, and identify the implications of immigration laws for the workplace.
